2. Object
Agentik is a lead acquisition and follow-up automation service using artificial intelligence agents, directed at dental clinics and aesthetic medicine practices. Access to and use of getagentik.co and any Agentik service implies full acceptance of these Terms & Conditions.
3. Service Description
Agentik provides:
Automated lead capture, qualification and follow-up systems using AI agents
Integration with the client's commercial communication channels (email, WhatsApp)
A control panel and activity reports
Technical support during the contracted period
Initial onboarding and configuration session
4. Ordering and Payment
The contract is formalised by accepting the commercial proposal and paying the corresponding amount.
Payments are processed via Revolut Business or the methods indicated in the proposal.
The monthly fee is due at the start of each billing period and is non-refundable except in cases of breach attributable to VRTC CONSULTORÍA SL.
Non-payment entitles us to suspend the service after 7 days' written notice.
All prices are stated in Euros (€) and are exclusive of applicable taxes. For clients based in the Netherlands (EU), no Spanish VAT applies; the reverse charge mechanism applies for B2B transactions.
5. Results Guarantee
Agentik offers a guarantee during the first 14 days from go-live. If the system is not operational due to causes attributable to the system, we will offer a free extension or full refund of the setup fee, at the client's choice.
The guarantee does not apply when the client has not provided the necessary access credentials, has not completed the onboarding session, or results depend on factors outside the system's control (e.g. the client's market conditions, no-show rates, or extremely low lead volume in the target area).
6. Client Obligations
Provide accurate and truthful information during configuration.
Grant the necessary access permissions for system integration.
Not use the service for activities contrary to applicable law.
Comply with data protection regulations (GDPR / AVG) when processing the leads captured by the system.
Not resell, sublicence or transfer access to the Agentik system to third parties without written consent.
7. Intellectual Property
All content at getagentik.co, including AI agent configurations, prompts, workflows and system design, is the property of VRTC CONSULTORÍA SL or its licensors. The client retains full ownership of all their own data. VRTC CONSULTORÍA SL acquires no rights over the client's lead data or patient data.
8. Confidentiality
Both parties agree to maintain the confidentiality of all information exchanged and not to disclose it to third parties without prior written consent. This obligation survives termination of the contract for a period of 2 years.
9. Limitation of Liability
VRTC CONSULTORÍA SL shall not be liable for: service interruptions caused by third-party providers (such as WhatsApp, Google, or email platforms); business losses resulting from the client's own commercial decisions; or indirect damages or loss of profits. Maximum liability is limited to the amount paid in the preceding 3 months.
10. Duration and Termination
The contract runs for the duration agreed in the commercial proposal, or on a rolling monthly basis if no fixed term is specified.
Either party may terminate with 30 days' written notice.
On termination, the client will receive their exportable data in CSV format within 10 working days.
Early termination by the client does not entitle the client to a refund of any setup fee paid.
11. Service Level (Uptime)
Agentik commits to system availability of 95% of monthly operating time. Planned maintenance (notified 24 hours in advance) does not count towards downtime. In the event of non-compliance, the client receives a credit equivalent to the downtime in their next monthly invoice.
12. Data Protection
Both parties will comply with Regulation (EU) 2016/679 (GDPR) and, for Netherlands-based clients, the UAVG. Agentik acts as data processor on behalf of the client with respect to the leads managed by the system. A Data Processing Agreement (DPA / Verwerkersovereenkomst) is available on request. 13. Modifications to the Service
We reserve the right to modify, improve or discontinue features of the service with reasonable notice. Material changes that negatively affect the client's contracted service will be notified at least 30 days in advance, giving the client the right to terminate without penalty.
14. Governing Law and Jurisdiction
These Terms are governed by Spanish law. For disputes not resolved amicably, the parties submit to the courts of Elche (Alicante), Spain, without prejudice to the client's right to bring proceedings in their country of domicile under applicable consumer or commercial law.
